These terms of use are entered into by and CCI joy family (“CCI joy family,” “we,” or “us”). The following terms and conditions (the “Terms of Use”) govern your access to and use of any of our ministry websites, including any material, functionality, and services made available on or through the Website or other applications. Please take the time to carefully read the Terms of Use before using the Website. By accessing and using the Websites, you acknowledge and agree to be governed by and comply with these Terms of Use. You must not access or use the Websites if you do not agree to these Terms of Use.

When communications from the Church are sent to the email address you specify on any of the Websites, they will be deemed delivered and effective.

The Website may contain message boards, chat rooms, pray together, prayer wall, shouts of praise, praise reports, forums, bulletin boards, content, live chats, and user stories (collectively, “Interactive Services”) that enable users to post, submit, publish, display, or transmit content or materials (hereinafter, “post”) to other users or other persons (hereinafter, “other persons”). Any User Contribution you make to the Websites will be considered public and non-proprietary. By submitting any User Contribution to the Websites, you allow us, our affiliates, and our service providers the right to use, reproduce, alter, perform, display, distribute, and otherwise make such material available to third parties for any purpose.

Monitoring And Enforcement

Without limiting the above, we reserve the right to fully cooperate with any law enforcement authority or court order requesting or directing us to reveal the identity or other information of anyone posting any materials on or via the Websites if such information is known. YOU RELEASE AND HOLD THE CHURCH, ITS AFFILIATES, LICENSEES, AND SERVICE HARMLESS. We reserve the right, in our sole discretion, to remove any User Contributions for any reason. Furthermore, we reserve the right, in our sole discretion, to take any action with respect to any User Contribution that we deem necessary or appropriate.

PROVIDERS FROM ANY CLAIMS ARISING FROM ANY ACTION TAKEN BY ANY OF THE FOREGOING PARTIES DURING OR AS A RESULT OF THEIR INVESTIGATIONS, AS WELL AS FROM ANY ACTIONS TAKEN AS A RESULT OF INVESTIGATIONS BY EITHER SUCH PARTIES OR LAW ENFORCEMENT AUTHORITIES.

However, we do not guarantee that every material will be reviewed before it is placed on the Websites, and we cannot guarantee that objectionable information will be removed promptly once it has been posted. The Websites, as well as all materials contained therein (collectively, “Online Material”), are the property of CCI joy family, its licensors, and other Online Material providers and are protected by Kenyan copyright, trademark, trade secret, and other intellectual property or proprietary rights laws. Unauthorized use of the Websites’ Online Materials may be in violation of these and other laws. Without the specific permission of the Church or the copyright owner, no part of the Online Materials may be reproduced, distributed, displayed, downloaded, or transmitted in any form or by any means. For the avoidance of doubt, Online Materials refer to any and all text, drawings, pictures, video, or audio sequences, as well as any images featured on the Websites.

You may not, for example, copy, reproduce, edit, adapt, distribute, or create any derivative works from any materials on the Websites, including but not limited to the production of websites, blogs, magazines, books, CDs/DVDs, and other electronic media; Delete or change any copyright, trademark, or other proprietary rights notices from copies of items from the Website; use or access this Website for any purpose other than personal, non-commercial use on your own computer or mobile device.

Claims and Reporting of Copyright Infringement.

Claims of copyright infringement are taken seriously by us. We will respond to copyright infringement notices that are filed in accordance with the law. If you feel that any items available on or through the Websites infringe on your copyright, you may request that those materials (or access to them) be removed from the Website by contacting our Copyright Agent in writing. The Church owns all rights to any submissions (“Submissions”) made by you, and you recognize that such Submissions are non-confidential. No acknowledgement or reward will be given to you since the Church owns all rights, including intellectual property rights, in and to Submissions.

Indemnification

As a result of your agreement, you agree to defend, indemnify and hold the Church and its subsidiaries and service providers as well as their respective officers, directors, employees, contractors and agents from and against any claims or liabilities that may arise out of or relate to your use of the Websites or your violation of these Terms of Use. Time Limits For Filing Claims

Jurisdiction And Governing Law

All aspects relating to the Websites and these Terms of Use, as well as any dispute or claim arising out of or in connection with them, are governed by and construed in accordance with Kenyan law, without regard to any choice or conflict of law provision. Any legal action, suit, or proceeding arising out of or relating to these Terms of Use or the Websites must be brought in Kenyan courts, which are situated in Nairobi and Kiambu County, respectively. You waive any and all objections to such courts having jurisdiction over you and to such courts having jurisdiction over you.

Applications For Mobile Devices

We may develop and deliver mobile application updates at our sole discretion from time to time, which may include upgrades, bug repairs, patches, other error corrections, deletions, and new features. You acknowledge that the Church is under no responsibility to provide such updates. The mobile application will automatically download and install all available updates based on your specific mobile settings, or you may receive notification of or be encouraged to download and install such updates. You realize that when using the mobile application, your carrier’s standard rates and costs, such as text messaging and data charges, will apply.

Complete Accord

The Terms of Use and our Privacy Policy are the only and final agreement between you and the Church regarding the Website, and they supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, concerning the Website.

Exchanges And Returns

Product Sold: If you desire to return a product, we will replace or exchange it or grant you a refund in the form of your original purchase once we receive it. Product in exchange for a donation: Once we get the returned item, we will replace or exchange it. Please call the ministry at 0734 255743 if there is an issue with your order.

Deliveries To Correctional Facility

Packages delivered to correctional facilities are not our responsibility. We will make every effort to follow our customers’ postal instructions, but orders that do not arrive at their specified locations will not be refunded. As a result, if you want to send a box to someone in prison, you must do so at your own risk and expense.

Geographical Constraints

The Websites are administered from Kenyan offices. The Church makes no claim that the Websites’ content or contents are appropriate or available for use in other countries. Access to the Websites’ information or materials is strictly banned from jurisdictions where such access is illegal. You use the Websites at your own risk if you access them from other jurisdictions. You are solely responsible for adhering to any applicable laws. THE CONTENT AND MATERIALS CONTAINED IN THE WEBSITES WILL BE GOVERNED BY THE LAWS OF KENYA, WITHOUT REGARD TO ANY CONFLICTS OF LAWS PRINCIPLES AND EXCLUDING THE UNITED NATIONS CONVENTION ON THE INTERNATIONAL SALE OF GOODS. If any provision of these Terms of Use is found to be invalid, illegal, or unenforceable by a court or other tribunal of competent jurisdiction for any reason, that provision will be eliminated or limited to the bare minimum, leaving the remaining provisions of the Terms of Use in full force and effect.
